CENSO ANUAL DE CAPITAIS ESTRANGEIROS NO PAÍS 2022 – PRAZO SE ENCERRA EM 15 DE AGOSTO

O prazo para apresentação da declaração do Censo Anual de Capitais Estrangeiros no País se encerra às 18h00 do dia 15/08/2022.

Regulada pela Circular 3795/2016 do Banco Central do Brasil (BCB), a declaração anual é obrigatória para (i) as pessoas jurídicas sediadas no país que, em 31/12/2021, possuíam (a) participação direta de não residentes em seu capital social, em qualquer montante, e patrimônio líquido igual ou superior a US$100.000.000,00 (cem milhões de dólares americanos); (b) saldo devedor total de créditos comerciais, exigíveis no prazo de 30 até 360 dias, concedidos por não residentes, em montante igual ou superior ao equivalente a US$10.000.000,00 (dez milhões de dólares americanos), e (ii) os fundos de investimento que, em 31/12/2021, possuíam cotistas não residentes e patrimônio líquido igual ou superior ao equivalente a US$100.000.000,00 (cem milhões de dólares americanos).

As pessoas físicas; órgãos da Administração Direta da União, Estados, Distrito Federal e Municípios; pessoas jurídicas devedoras de repasses de créditos externos concedidos por instituições sediadas no País; e entidades sem fins lucrativos mantidas por contribuição de não residentes estão desobrigados de prestar esta declaração.

Ressaltamos que a não apresentação da declaração do Censo Anual de Capitais Estrangeiros no País, bem como sua entrega fora do prazo ou com vícios, poderá acarretar na aplicação de multas pelo BCB, conforme normas em vigor.

 


ANNUAL FOREIGN CAPITAL IN THE COUNTRY CENSUS 2022 – DEADLINE EXPIRES ON AUGUST 15TH

 

The deadline for filing the Foreign Capital in the Country Census report expires on August 15th, 2022, at 6:00 pm.

As stated by Regulation 3795/2016 of the Brazilian Central Bank (BCB), the annual report is mandatory for (i) legal entities headquartered in Brazil that, on December 31st, 2021, had (a) direct interest of non-residents in their capital stock, in any  amount, and net equity equal to or greater than US$100,000,000.00(one hundred million American dollars); (b) total debit balance of trade credits, payable from 30 to 360 days, granted by non-residents, in an amount equal to or greater than the equivalent of US$10,000,000.00 (ten million American dollars), and (ii) investment funds which, on December 31st, 2021, had non-resident shareholders and net equity equal to or greater than the equivalent of US$100,000,000.00 (one hundred million American dollars).

Individuals; agencies of the Direct Administration of the Union, States, Federal District and Municipalities; legal entities debtor for on-lending of external credits granted by institutions headquartered in the country; and non-profit entities supported by contributions from non-residents are not required to file this report.

We emphasize that failure to present the report of Foreign Capital in the Country Census, as well as its delivery after the deadline or with misinformation, may result in fines imposed by the BCB, according to the regulation in force.
