Intellectual Property

FIUS's Intellectual Property practice provides legal counsel for the protection of trademarks, patents, industrial designs, scientific, literary and artistic works, software and plant varieties — both in Brazil and abroad. We advise clients on administrative and judicial matters and support the drafting of IP-related contracts, including licensing, assignment, distribution, franchising, naming-rights, confidentiality, partnership and technical-cooperation agreements, and know-how and technology transfers.

We also handle the strategic management of our clients' IP portfolios, supporting the protection of intangible assets and actively pursuing cases of trademark conflict, unfair competition and improper use of intellectual-property rights by third parties.

  • Filing of applications for trademarks, industrial designs, patents and plant varieties, domestically and internationally;
  • Prior-art searches, drafting of descriptive reports, claims, drawings and other formalities for patent filings in Brazil and abroad;
  • Freedom to Operate (FTO) reports;
  • Drafting of IP-related contracts, including licensing, assignment, partnership and technical cooperation, know-how and technology transfer, confidentiality agreements and others;
  • IP portfolio management;
  • Drafting of judicial and extrajudicial notifications regarding alleged IP infringements;
  • Due diligence and audits to identify risks related to the use of intellectual-property rights;
  • Innovation consulting (innovation funnel), participation in patent and innovation committees, lectures and related activities, project feasibility studies developed with R&D, and marketing development;
  • Legal opinions on intellectual-property matters.
