Our Intellectual Property area at Finocchio & Ustra provides legal assistance for the protection of brands, patents, industrial designs, scientific, literary and artistic works, computer programs and cultivars in Brazil and abroad. Our team advises our clients in both administrative and judicial matters, and we offer support in drafting contracts related to intellectual property rights, such as licensing, assignment, distribution, franchise, naming rights, confidentiality agreements, partnerships and technical cooperation, and transfer of know-how and technology.
Our area also carries out strategic management of our clients’ intellectual property portfolio by assisting in the protection of intangible assets, and actively engaging in cases involving trademark conflict, unfair competition and improper use of intellectual property rights by third parties.
Among the main areas of activity, the following stand out:
- Filing applications for registration of national and international trademarks, industrial designs, patents and cultivars;
- Search for prior art, preparation of descriptive report, claims, drawings and other formalities for filing patents in Brazil and abroad;
- Freedom to Operate – FTO;
- Drafting of contracts involving intellectual property, such as licensing, assignment agreements, partnership and technical cooperation, transfer of know-how and technology, confidentiality agreements, among others;
- Intellectual property portfolio management;
- Preparation of in- and out-of-court notifications on any breach of intellectual property rights;
- Due diligence and auditing aimed at identifying risks related to the use of intellectual property rights;
- Consulting in technological innovation (innovation funnel); Participation in patent and innovation committees, lectures and the like, feasibility studies of projects developed by R&D and marketing development;
- Issuance of opinions and legal opinions on matters of intellectual property rights.
